Monday, the 29TH day of NOVEMBER 2020, being the Monday next after the expiration date of forty-two days after this citation is issued, and you are hereby commanded and required then and there to appear and file written answer to the Plaintiffs Original Petition and Discovery to Defendants, filed in said Court on the 17th day of July 2020, in a suit numbered 2020-42777 docket of said court, wherein the Plaintiff, JOHNSON, JACOB and HAMILTON, BRANDI and the Defendant(s), CLEMONS, MARVIS and GREATER HOUSTON TRANSPORTATION the nature of plaintiff’s demand and the said petition alleging: Motor Vehicle Accident On September 23, 2019, Defendant MARVIS CLEMONS was driving a vehicle in the course and scope of her employment/contract with Defendant GREATER HOUSTON TRANSPORTATION COMPANY. On that day, CLEMONS was driving westbound in the 3700 block of N. IH 610, when she attempted to change lanes, and suddenly, violently, and without warning, hit a vehicle and then crashed into the Plaintiffs’ vehicle. The negligence of Defendant CLEMONS set in motion a chain reaction that ended with three vehicles and an 18-wheeler damaged in the collision. Defendant CLEMONS received a citation for changing lanes when unsafe. As a proximate result of the negligence and/or gross negligence of MARVIS CLEMONS, Plaintiffs sustained personal injuries and damages. Nothing Plaintiffs did or failed to do caused or contributed to the incident made basis of this suit or their resulting injuries and damages. Notice hereof shall be given by publishing this Citation once a week for four consecutive weeks previous to the day of NOVEMBER 29th, 2020, in some newspaper published in the County of Harris, if there be a newspaper published therein, but if not, then the nearest county where a newspaper is published, and this Citation shall be returned on the 27th day of NOVEMBER 2020, which is forty two days after the date it is issued, and the first publication shall be at least twenty-eight days before said return day. HEREIN FAIL NOT, but have before said court on said return day this Writ with your return thereon, showing how you have executed same.
