DANIEL, JR., deceased; TO ANY UNKNOWN HEIRS of FLOYD E. DANIEL, JR., deceased; TO ANY NON-RESIDENT HEIRS of FLOYD E. DANIEL, JR., deceased; and TO ANY HEIRS of FLOYD E. DANIEL, JR., deceased, WITHOUT THE STATE OF TEXAS. No. 20200505PR1 County Court of McLennan County, Texas On the 15th day of October, 2020, Pamela Ray Daniel (“Applicant”), filed an Application To Determine Heirship Under Section 202.005 Of The Texas Estates Code, furnishing the following information to the Court: Floyd E. Daniel, Jr. (“Decedent”), to the best of the Applicant’s knowledge, died intestate on June 7, 2020 in Waco, McLennan County, Texas at the age of 67 years. Decedent’s domicile at the time of death was in Waco, McLennan County, Texas. This Court has jurisdiction and venue because Decedent was domiciled in Texas and had a fixed place of residence in this County on the date of his death. Applicant is an individual interested in the Estate, domiciled in Waco, McLennan County, Texas and is the surviving spouse of the Decedent. It is in the best interest of the Estate for the Court to determine who are the heirs and only heirs of the Decedent. The names and residences of all Decedent’s heirs, the relationship of each heir to Decedent and the true interest of the Applicant and of each of the heirs in the Estate of Decedent are as follows: Pamela Ray Daniel of Waco, Texas, Surviving Spouse, Age: 65 Years; Share of Real Property (Decedent’s ½ interest in Community Property): 100%, Share of Personal Property (Decedent’s ½ interest in Community Property): 100%, Share of Real Property (Decedent’s Separate Property): 1/3 life estate, Share of Personal Property (Separate Property): 1/3; Thomas Floyd Daniel of Gordonville, Texas, Son, Age: 42 Years, Share of Real Property (Community Property): 0%, Share of Personal Property (Community Property): 0%, Share of Real Property (Separate Property): 1/2/ of 2/3rds life estate interest, and ½ remainder interest, Share of Personal Property (Separate Property): 1/3; Angela Rae Carter of Sherman, Texas, Daughter, Age: 39 Years, Share of Real Property (Community Property): 0%, Share of Personal Property (Community Property): 0%, Share of Real Property (Separate Property): 1/2 of 2/3rds life estate interest, and ½ remainder interest, Share of Personal Property (Separate Property): 1/3. At the time of Decedent’s death, Decedent owned the following property: Real Property: House at 10616 Rayburn Way, Waco, Texas 76708 and Several real estate properties in Grayson County, Texas, (no value given). Personal Property: Cash in bank accounts, Vehicles, Pontoon boat, Personal effects and household furnishings, (no value given). The only children born to or adopted by the Decedent are: Thomas Floyd Daniel, Date of Birth: 10/11/1978, Birthplace: Sherman, Texas and Angela Rae Carter, Date of Birth: 04/07/1981, Birthplace: Sherman, Texas. Decedent was married one time during his lifetime, to Pamela Ray Daniel on June 8, 1973. This marriage was terminated by Decedent’s death. Two children were born to this marriage: Thomas Floyd Daniel and Angela Rae Carter, Decedent had no deceased children and never adopted any children. Each marriage of Decedent has been listed and all children born to or adopted by the Decedent have been listed. The Application states that it does not omit any information required by Section 202.005 of the Texas Estate Code. Applicant prays that citation issue as required by law to all persons interested in this Estate; that upon hearing hereof, the Court determine who are the heirs and only heirs of Decedent and their respective shares and interests in this Estate; and that all other Orders be entered as the Court may deem proper. Said Application will be heard and acted on by said Court at 10:00 a.m. on the first Monday next after the expiration of ten days from date of publishing this citation, the same being the 11/09/2020 at the Courthouse thereof in Waco, McLennan County, Texas, at which time and place all persons interested in this Application to Determine Heirship, are hereby cited and required to appear by filing a written answer and contest to said application.
