CITATION BY PUBLICATION – Rule 114 & 109 – Rules of Civil Procedure RUN ONCE A WEEK FOR FOUR (4) CONSECUTIVE WEEKS TO: THE UNKNOWN HEIRS OF JACK SCRIBNER, DECEASED NOTICE TO RESPONDENT: “You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty two days after you were served this citation and petition, a default judgment may be taken against you.” GREETING: You are hereby commanded to appear by filing a written answer to the PETITION FOR CONDEMNATION at or before 10:00 o’clock a.m. of the first Monday after the expiration of 42 days from the date of issuance of this citation, the same being Monday the 30th day of November, 2020 at or before 10 o’clock a.m., before the Honorable David Rippel in the County Court At Law 4 in Collin County, at the Courthouse in McKinney, Texas. Said PETITION FOR CONDEMNATION was filed on April 09, 2019 in this case, numbered 004-01138-2019 on the docket of said court, and styled: THE STATE OF TEXAS V. JUANITA SCRIBNER, ET AL. The names of the parties to the cause are as follows: STATE OF TEXAS is Plaintiff and JUANITA SCRIBNER; ROY WAYNE SCRIBNER; DEBBIE SCRIBNER; THE UNKNOWN HEIRS OF JACK SCRIBNER, DECEASED are Defendants. A brief statement of the nature of the suit is as follows, to-wit; as is more fully shown by PETITION FOR CONDEMNATION on file in this suit: “You are hereby notified that a hearing will be held at 10:00 o’clock a.m., on the first Monday after the expiration of forty-two (42) days from the date of issuance hereof, that is to say Monday, the 30th day of November, 2020 at Collin County TxDOT Maintenance Area Office, 2205 South SH 5, McKinney, Texas 75069, to assess the damages due the owner of the property being condemned. The State of Texas filed a Petition for Condemnation with the Judge of the County Court at Law No. 4 of Collin County, Texas, on the 9th day of April, 2019, in Cause No. 004-01138-2019 which is styled The State of Texas v. Juanita Scribner, et al. The Plaintiff is the State of Texas. The Defendants are: Juanita Scribner; Roy Wayne Scribner; Debbie Scribner; and The Unknown Heirs of Jack Scribner, Deceased. The name and address of the attorney for Plaintiff is John Oliver, Assistant Attorney General, P.O. Box 12548, Austin, Texas, 78711-2548. This suit is an eminent domain proceeding in which the State of Texas is condemning a tract of land located in Collin County, Texas, containing 6,810 square foot (0.1563 acre) tract of land situated in the Granderson Stark Survey, Abstract No. 798, located in the City of Anna, Collin County, Texas, and being a portion of that called 3.207 acre tract of land described in deed to Jack Scribner and Wife, Juanita Scribner, recorded in Volume 656, page 388 of the Deed Records of Collin County, Texas (D.R. C.C.T.), and being a portion of Lot 1, Block A of the Final Plat of Lot 1&2, block A, Scribner Addition, an addition to the City of Anna, recorded in Instrument No. 20160627010002610, Official Public Records of Collin County, Texas (O.P.R.C.C.T.) containing the property fully described in Exhibit “A” of Plaintiff’s Petition for Condemnation filed under the above-referenced cause number. Signed: 10/16/2020 2:56:46 PM The interests of these Defendants are that they either own or claim an interest in said property, subject to unpaid accrued taxes. You are further notified that you may appear at the hearing before Special Commissioners and present evidence you desire on the issue of damages to be assessed against the State. If you do not appear at the hearing, the Special Commissioners may proceed to assess the damages of the owner of the property be condemned.” If this citation is not served within ninety days after the date of its issuance, it shall be returned unexecuted. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates thereof, and make due return as the law directs.
