THE STATE OF TEXAS To any Sheriff or any Constable within the State of Texas-----GREETING: YOU ARE HEREBY COMMANDED to cause to be published, ONCE, not less than ten days before the return day thereof, exclusive of the date of publication, in a newspaper of general circulation printed and/or published in McLennan County, Texas, the accompanying citation, of which the herein below is a true copy. __________________________________________________________________________________________ CITATION BY PUBLICATION THE STATE OF TEXAS TO ALL PERSONS INTERESTED IN THE ESTATE of ROBERT HAROLD COBB, deceased; TO ANY UNKNOWN HEIRS of ROBERT HAROLD COBB, deceased; TO ANY NON-RESIDENT HEIRS of ROBERT HAROLD COBB, deceased; and TO ANY HEIRS of ROBERT HAROLD COBB, deceased, WITHOUT THE STATE OF TEXAS. No. 20200336PR1 County Court of McLennan County, Texas On the 16th day of July, 2020, Rebecca Ann Harrell, Applicant, filed an Application for Determination of Heirship to have the Court determine and declare who are the heirs and only heirs of Robert Harold Cobb, Decedent, and in support thereof Applicant respectfully shows the following: Applicant is an individual interested in this Estate by reason of having been the Decedent’s sister. Applicant is domiciled and resides in Scottsdale, Maricopa County, Arizona 85260. No final disposition of the Estate has been made. It is in the best interest of the Estate for the Court to determine who are the heirs and only heirs of the Decedent. Decedent died intestate, without leaving a will. Decedent’s Father, Harold C. Cobb, died on February 6, 2017 and predeceased the Decedent. To the best of Applicant’s knowledge, Decedent’s Mother, Marilyn Smith Taylor and Applicant are Decedent’s sole heirs and distributees. Decedent died intestate on May 17, 2020 in Temple, Bell County, Texas, at the age of fifty-three (53) years. The Court has jurisdiction and venue is proper because the Decedent was domiciled and had a fixed place of residence in McLennan County at the time of his death. As far as known by Applicant at the time of the filing of this Application, the name, age, marital status, address, and the relationship, if any, of each heir to the Decedent are as follows: Marilyn Taylor Smith, 86, Married, San Angelo, Texas 76904-7451, Mother; Rebecca Ann Harrell, 60, Divorced, Scottsdale, Arizona 85260, Sister. As far as known by Applicant at the time of the filing of this Application, no children were actually born to, or adopted by the Decedent. Decedent was not and had never been married at the time of his death. All referenced to marriages and children of Decedent have been listed in this Application. The following is a general description of property owned by the Decedent: Property located at 953 Morning Star, China Spring, McLennan County, Texas 76633; Property located at 6801 Airport Road, Waco, McLennan County, Texas 76708; Community Bank and Trust Account; Robert Cobb Trust Account with Schwab; Merrill Lynch Account; 2015 Chevrolet Pickup Truck; and miscellaneous personal property. To the best of Applicant’s knowledge, this Application does not omit any information required by the Texas Estates Code. Applicant requests that citation be issued to all persons interested in this Estate as required by law; that the Court enter an order determining that Applicant, Rebecca Ann Harrell, and Marilyn Smith Taylor are the sole heirs and distributees of his Estate; that this Court render a judgment declaring the names and places of residence of all the heirs of the Decedent and their respective shares and interests in the real and personal property of the Decedent; and that such other and further orders be made, as the Court may deem proper. Said Application will be heard and acted on by said Court at 10:00 a.m. on the first Monday next after the expiration of ten days from date of publishing this citation, the same being the 08/10/2020 at the Courthouse thereof in Waco, McLennan County, Texas, at which time and place all persons interested in this Application for Determination of Heirship, are hereby cited and required to appear by filing a written answer and contest to said application.
