This suit is brought by the Department of Family and Protective Services, whose address is 3610 Vine St., Abilene, TX 79602. The following children are the subject of this suit: Cynthia Renteria, Female, DOB March 15, 2004 and Greg Hernandez, Male, DOB July 13, 2006. The mother of the child the subject of this suit is Rosa Martinez, DOB April 19, 1967, 1018 Cedar St, Abilene, TX 79601. The father of the child Cynthia Renteria is Rafael Renteria, DOB March 21, 1955, 1218 Cherry St, Abilene, TX 79602. The father of the child Greg Hernandez is Fidel Hernandez, DOB March 23, 1964, 2856 CR 216, Breckenridge, TX 76424. To the Department’s knowledge, there are no Court-ordered conservatorships, guardianships, or other court-ordered relationships affecting the child the subject of this suit. To the best of the Department’s knowledge, there are no protective orders in effect or applications pending in regard to a party to the suit or a child of a party to the suit. The Department made reasonable efforts, consistent with time and circumstances prior to the child’s removal and prior to the placement of the child in foster care, to prevent or eliminate the need for removal of the child and the Department has made reasonable efforts to make it possible for the child to return home. There is an immediate danger to the physical health or safety of the children, or the children has been the victim of neglect or sexual abuse. Continuation in the home would be contrary to the child’s welfare. The Department requests emergency orders and/or attachments required to gain possession of the child. The Department requests that each Parent, Alleged Father or Relative of the child before the Court provide the full name and current address or whereabouts about phone number of any absent parent of the child the subject of this suit. The Department requests the Court to determine whether Fidel Hernandez is the father of Greg Hernandez. At the full adversary hearing, the Court should render a provision appointing the Department temporary sole managing conservator of the child, with all rights and duties, a provision that any child support ordered to be paid for the support of the children, a provision restricting the parents’ possession and access to the child the subject of the suit. If the child cannot safely be reunified with either parent, but may be permanently placed with a relative or other suitable person, the Department requests that the Court appoint the person as permanent sole managing conservator; if the child cannot be safely ruinified with either parent or permanently placed with a relative or other suitable person, the Department requests that the Court appoint the Department as permanent sole managing conservator of the child. If reunification with the father cannot be achieved, the Court should terminate parent-child relationship between Fidel Hernandez and Greg Hernandez the subject of this suit because termination of the parent-child relationship is in the child’s best interest.
