You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two days after the date of issuance of this citation and petition, a default judgment may be taken against you." Schwartz, Deceased You are hereby commanded to appear by filing a written answer to the Plaintiffs' Second Amended Original Petition at or before 10:00 A.M. of the Monday next after the expiration of forty-two days after the date of issuance of this citation the same being Monday, the 18th day of January, 2021 before the 284th Judicial District Court of Montgomery County, Texas at the Courthouse of said County in Conroe, Texas. Said Plaintiffs' Second Amended Original Petition was filed in said court on this the 9th day of November, 2020, in this case, numbered 18-10-13729- CV on the docket of said court. The names of the parties to the cause are as follows: Eugene Martin, Gary Green, Cynthia Green Chivell, Mike Eberle, as Trustee of Martha Carol Green Eberle Trust, Jim Green, Teresa Hamman, Jane Green Pensala, Billie Jean Green Roy and Cheryl Green Vinson are Plaintiffs and Paul Green; Sandra E. Schwartz, Deceased, and Unknown Heirs, Joseph Anthony Schwartz, and Unknown Heirs are Defendants A brief statement of the nature of this suit is as follows, to wit: This is an action for heirs to partition 3 acres of real property, more fully described in a Deed dated June 30, 1960, recorded by Deed in Volume 485, Pages 10-11 of the Property Records of Montgomery County, Texas. A true and correct copy of the Deed is attached as Exhibit B to Plaintiffs’ Second Amended Original Petition filed November 9, 2020, and is incorporated by reference. This real property is hereafter referred to as “the property”, a 3 acre tract. as is more fully shown by Plaintiffs' Second Amended Original Petition on file in this suit. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates thereof, and make due as the law directs.
