You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two days after the date of issuance of this citation and petition, a default judgment may be taken against you." To: The Bonanza Corporation You are hereby commanded to appear by filing a written answer to the Plaintiff's Original Petition at or before 10:00 A.M. of the Monday next after the expiration of forty-two days after the date of issuance of this citation the same being Monday, the 18th day of January, 2021 before the 284th Judicial District Court of Montgomery County, Texas at the Courthouse of said County in Conroe, Texas. Said Plaintiff's Original Petition was filed in said court on this the 7th day of July, 2020, in this case, numbered 20-07-07938-CV on the docket of said court. The names of the parties to the cause are as follows: Mary Beth Smith are Plaintiffs and The Bonanza Corporation are Defendants A brief statement of the nature of this suit is as follows, to wit: The subject real property was deeded to Plaintiff on or about July 6th, 1998 by Plaintiffs’ father, Samuel L. Smith. The Defendant, The Bonanza Corporation sold the subject real property to Samuel L. Smith and wife, Jean Smith, March 29, 1972 without recording a deed. This husband and wife built a house and erected other valuable improvements upon the real property in March of 1972 and possessed the property until the death of Jean Smith, who passed away interstate in 1990, leaving 3 heirs, Husband, Samuel L. Smith, 1 Son, Samuel Smith, and 2 daughters, Carol Elain Rodriguez and Mary Beth Smith. Samuel Smith possessed the subject real property until he deeded it to Mary Beth in 1998 who has owned, possessed, and occupied the property ever since. Plaintiff has been in possession of the subject real property and enjoyed it for a period that exceeds ten years, and in fact, has enjoyed it continuously for Twenty-one years. Plaintiff has been unable to locate Defendants’ registered agent due to the fact the Corporation is no longer in existence. as is more fully shown by Plaintiff's Original Petition on file in this suit. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates thereof, and make due as the law directs.
