THE STATE OF TEXAS To any Sheriff or any Constable within the State of Texas-----GREETING: YOU ARE HEREBY COMMANDED to cause to be published, ONCE, not less than ten days before the return day thereof, exclusive of the date of publication, in a newspaper of general circulation printed and/or published in McLennan County, Texas, the accompanying citation, of which the herein below is a true copy. __________________________________________________________________________________________ CITATION BY PUBLICATION THE STATE OF TEXAS TO ALL PERSONS INTERESTED IN THE ESTATE of JAMES ALLEN SCHROTEL, deceased; TO ANY UNKNOWN HEIRS of JAMES ALLEN SCHROTEL, deceased; TO ANY NON-RESIDENT HEIRS of JAMES ALLEN SCHROTEL, deceased; and TO ANY HEIRS of JAMES ALLEN SCHROTEL, deceased, WITHOUT THE STATE OF TEXAS. No. 20200318PR1 County Court of McLennan County, Texas On the 6th day of July, 2020, Read Scott Schrotel (“Applicant”), filed an Application For Determination Of Heirship stating that James Allen Schrotel (“Deceased”), died in McLennan County, Texas, on June 4, 2020 intestate. An administration on the Estate is pending in the Court and has not reached final disposition. The Applicant is a person claiming to be the owner of part of the Estate of the Decedent. Joined as parties’ respondent in this proceeding are Sherryl Leigh Schrotel Viars, James Chadleigh Schrotel, Margaret Katherine Schrotel Flores and Frances Leigh Schrotel Polk. The application states each respondent will file a waiver of citation in this action. Applicant pleads that discovery should be conducted in accordance with Civil Procedure Rule 190.2. The Decedent was married only once, that being to Margaret Leigh Metz Hawes. They divorced on November 5, 1976. They had five (5) and only five (5) children. The names and residences of Decedent’s heirs, the relationship of each heir to the Decedent, and the true interest of the Applicant and each of the heirs in the Estate of the Decedent, are as follows: Sherryl Leigh Schrotel Viars of Richardson, Texas, daughter, Interest: one-fifth; Read Scott Schrotel of Waco, Texas, son, Interest: one-fifth; James Chadleigh Schrotel of McGregor, Texas, son, Interest: one-fifth; Margaret Katherine Schrotel Flores of Wichita, Kansas, daughter, Interest: one-fifth; and Frances Leigh Schrotel Polk of Roanoke, Texas, daughter, Interest: one-fifth. The application states that all surviving children of Decedent have been listed and each marriage of the Decedent has been listed with the date of the marriage, name of the spouse, and, if the marriage was terminated, the date of termination, together with other facts showing whether a spouse has had an interest in the Decedent’s property. The Applicant request that respondents be cited to appear and answer, and that on final hearing of this cause, the Court: Determine and declare who are the heirs and only heirs of the decedent and their respective shares and interests in the Estate of the Decedent. Award Applicant such other and further relief to which he may be justly entitled. Said Application will be heard and acted on by said Court at 10:00 a.m. on the first Monday next after the expiration of ten days from date of publishing this citation, the same being the 07/27/2020 at the Courthouse thereof in Waco, McLennan County, Texas, at which time and place all persons interested in this Application For Declaration of Heirship, are hereby cited and required to appear by filing a written answer and contest to said application.
