CITATION BY PUBLICATION STATE OF TEXAS You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two days from the date of the issuance of this citation, a default judgment may be taken against you. You are hereby commanded to appear by filing a written answer to the Plaintiff’s First Amended Application for Appointment of Receiver at or before ten o’clock a.m. of the Monday next after the expiration of forty-two days from the date of the issuance of this citation, same being Monday October 5, 2020, before the Honorable LeAnn Rafferty, 123rd Judicial District Court of Panola County, Texas, at the Court House of said County in Carthage, Texas. CRAIN ENERGY, LTD., Petitioner, filed suit in said Court on the 11th day of August, 2020, against WILLIAM ERNEST MCCLELLAND, JAMES R. STUDDARD, AUDREY BARNETT BOYETT, JOHNNY MERLE BOYETTM A.J. BOYETT, ETHELENE HARRISON, JAMES M. HARRISON, JR., CATHRINE LYNN AKERVIK AKA CATHERINE LYNN BOYCE, and their Unknown Heirs Successors, or Assigns, Defendant, and said suit being numbered 2020-250 on the docket of said Court, and styled, CRAIN ENERGY, LTD. vs. WILLIAM ERNEST MCLELLAND, JAMES R. STUDDARD, AUDRET ARNETT BOYETT, JOHNNY MERLE BOYETT, A.J. BOYETT, ETHELENE HARRISON, JAMES M. HARRISON, JR., CATHERINE LYNN AKERVIK AKA CATHERINE LYNN BOYCE, AND THEIR UNKNOWN HEIRS, SUCCESSORS OR ASSIGNS, OR ANYONE CLAIMING INTEREST THROUGH THEM. A brief statement of the nature of this suit is as follows, to wit: Plaintiff is seeking Appointment of a Receiver to execute oil, gas, and mineral lease, assignment, memorandum of oil and gas lease or other necessary documents relating to the undivided mineral and leasehold interest for the following tracts of land: 246-1: 24.4 acres of land, more or less, a part of the D.H. Gray Survey, A-246 and the F, Moseley Survey, A-466, Panola County, Texas, and being the same land described in that certain Warranty Deed with Vendor’s Lien dated December 11, 1992, from Jimmie Rupe to Lynn Jene Rogers and wife, Bridgette Rogers, recorded in Volume 905, Page 360, of the Deed of Records of Panola County, Texas. 246-2: 24.4 acres of land, more or less a part of the Daniel H. Gray Survey, A-246, Panola County, Texas and being the same land described as “Lot 2” in that certain Warranty Deed dated September 18, 1941, from H.D. Barnett, et al to the Hairs of T.H. Barnett recorded in Volume 138, Page 532, of the Deed Records of Panola County, Texas. 246-3: 25.2 acres of land, more or less, a part of the Daniel H. Gray Survey, A-246, Panola County, Texas and being the same land described as “Lot 3” in that certain Warranty Deed dated September 18, 1941 from Mrs. Viola Creech, et al to Alta Barnett recorded in Volume 139, Page 230, of the Deed Records of Panola County, Texas. 246-4: 11.31 acres of land, more or less, a part of the Daniel H. Gray Survey, A-246, Panola County, Texas and being the same land described in that Special Warranty Deed with Vendor’s Lien dated, May 27, 2000, from Milton Huff to Glen Holloway and wife, Anne Holloway recorded in Volume 1130, Page 24, of the Official Public Records of Panola County, Texas. 246-5: 12.2 acres of land, more or less, in the Daniel H. Gray Survey, A-246, Panola County, Texas, and being more particularly described as being part of Lot #4, in that certain Warranty Deed, Dated July, 20, 1978, by and between Jimmie Barnett Rupe as Grantor, and Harvey Denson Barnett, as Grantee, and being recorded in Volume 648, Page 786, of the Deed Records of Panola County, Texas. 246-6: 24.4 acres of land, more or less, a part of the Daniel H. Gray Survey, A-246, Panola County, Texas and being the same land described as “Lot 5” in that certain Warranty Deed dated, September 18, 1941, from L.S. Barnett, et al to the Heirs of Laura McCleland Recorded in Volume 139, Page 227, of the Deed Records of Panola County, Texas. 246-7: 24.4 acres of land, more or less, a part of the Daniel H. Gray Survey, A-246, Panola County, Texas and being the same land described as “Lot 6” in that certain Warranty Deed dated September 18, 1941, from Viola Creech et al to Mrs. Evie Walker recorded in Volume 138, Page 539, of the Deed Records of Panola County, Texas. 246-8: 24.4 acres of land, ,more or less, a part of the Daniel H, Gray Survey, A-246, Panola County, Texas and being the same land described as “Lot 7” in that certain Warranty Deed dated September 18, 1941, from L.D. Walker, et al to Mrs. Viola Creech recorded in Volume 139, Page 340, of the Deed Records of Panola County, Texas. 246-9: 24.4 acres of land, more or less, a part of the Daniel H. Gray Survey, A-246, Panola County, Texas and being the same land described as “Lot 8” in that certain Warranty Deed dated, September 18, 1941, from H.D. Barnett, et al to L.S. Barnett recorded in Volume 138, Page 629, of the Deed Records of Panola County, Texas. Petitioner is represented by RICKEY L. FAULKNER, P.O. BOX 2665, LONGVIEW, TEXAS 75606. If this Citation is not served within ninety days after the date of issuance, it shall be returned unserved. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates hereof, and make due return as the law directs.
