THE STATE OF TEXAS TO: DAVID PEREZ, AN INDIVIDUAL AND THE UNKNOWN HEIRS OF IGNACIO ZARAGOZA PEREZ, DECEASED, SUCCESSORS AND ASSIGNS AND ALL PERSONS WHOSE NAMES AND WHEREABOUTS ARE UNKNOWN AND CLAIMING ANY TITLE OR INTEREST IN property, containing 0.036 acre parcel of land, situated in Starr County, Texas, and being out of Porcion 78, Abstract 82, of the former jurisdiction of Camargo, Tamaulipas, Mexico, now Starr County, Texas The interests of these Defendants are that they either own or claim an interest in said property. You are further notified that you may appear on Case No. CC-20-79 at the hearing before the Special Commissioners and present evidence you desire on the issue of damages to be assessed against the City of Rio Grande City. If you do not appear at the hearing, the Special Commissioners may proceed to assess the damages of the owner of the property being condemned. GREETINGS: YOU ARE HEREBY COMMANDED TO APPEAR BEFORE THE STARR COUNTY COURT AT LAW AND ANSWER to this suit CC-20-79 which is an eminent domain proceeding in which the City of Rio Grande City is condemning a tract of land located in Starr County, Texas, containing 0.036 acre parcel of land, situated in Starr County, Texas, and being out of Porcion 78, Abstract 82, of the former jurisdiction of Camargo, Tamaulipas, Mexico, now Starr County, Texas, and being a portion of Tract 2 and all of Tract 3, as described in Volume 450, Page 892, of the Deed Records, Starr County, Texas, such property being fully described in Exhibit A of Plaintiff's Petition for Condemnation filed under the above-referenced cause number NOTICE: YOU HAVE BEEN SUED. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation at or before 10:00 o’clock of the first Monday after the expiration of 42 days from date of issuance of this citation a default judgment may be taken against you. Your answer is due no later than 10 o'clock a.m. on Monday, September 28, 2020 and must be filed with the office of the Clerk at 401 North Britton Avenue, Starr County Courthouse, 2nd Floor, Rio Grande City, Texas AND there to answer to the Plaintiff’s First Amended Petition for Condemnation in Cause No. CC-20-79 which is styled : “THE CITY OF RIO GRANDE CITY V. THE ESTATE OF IGNACIO ZARAGOSA PEREZ, DECEASED AND DAVID PEREZ, OWNER” The amended petition in this case was filed on March 06, 2020 in the County Court at Law, Rio Grande City, Starr County, Texas.
