The below described tract is the property the subject of this suit: All that certain 50 acre tract of land (sometimes referred to as the Northwest one-half of 100 acres), being out of and a part of the Samuel Davidson Survey, Abstract No. 13, Brazos County, Texas. Said 100 acre tract being the same tract of land described in a deed to Joshua and wife Elvira Washington, dated November 24, 1911 and recorded in Volume 39, Page 24 of the Official Records of Brazos County, Texas. You are commanded of appear and of answer before the 85th Judicial District Court of Brazos County, Texas, at or before 10:00 a.m. on the first Monday after the expiration of 42 days from the date of issuance of this citation, being at or before 10:00 a.m. on Monday, the 19TH day of OCTOBER, 2020, then and there to answer the Intervenor/Defendant Curtis Capps Fifth Amended Original Answer and Fifth Amended Counterclaim and Fourth Amended Third Party Claim on file in Cause No. 16- 000649-CV-85. The Petition, filed on June 26, 2020 discloses that the nature of the suit is a partition proceeding through Chapter 23 of the Texas Property Code, said property situated in Brazos County, Texas, that is the subject of the above suit. If this citation is not served within 90 days after the date of its issuance, it shall be returned unserved.
