NOTICE BY PUBLICATION STATE OF TEXAS TO: Elzie H. Taylor a/k/a E. H. Taylor and the Unknown Heirs of Elzie H. Taylor a/k/a E. H. Taylor, Defendant, and to all whom it may concern: You have been sued. You may employ an attorney. You are hereby notified that on the 7th day of October, 2020, at 10:30 A.M. in the Commissioners Courtroom, located in the Alan B. Sadler Commissioners Court Building, 501 N. Thompson, Comoe, Montgomery County, Texas, the Special Commissioners, Kathleen Oates, Bob Bagley and JoAnn Bullock, will meet and proceed to hear the evidence from all patties hereto so as to enable them to fix the value of and assess the damages occasioned by the condemnation of the subject property generally described as "Being a 0.0059 acre (256 Square Foot (SQ. FT.)) tract of land located in the F. McNaughton Survey, Abstract No. 392, Montgomery County, Texas, also being out of and a part of the remainder of a called 32-34/100 acre tract of land, as deeded to Elzie H. Taylor a/k/a/ E.H. Taylor, and recorded in Volume (Vol.) 184, Page (Pg.) 154 of the Montgomery County Deed Records (M.C.D.R.)." The petition of New Caney Municipal Utility District, Plaintiff, was filed against Elzie H. Taylor a/k/a/ E. H. Taylor, and the Unknown Heirs of Elzie H. Taylor a/k/a/ E. H. Taylor, Defendant, on July 6, 2020, in the County Court at Law, Number 2 of Montgomery County, Texas, and is numbered 20-07-07892, and entitled New Caney Municipal Utility District v. Elzie H. Taylor a/k/a/ E. H. Taylor and the Unknown Heirs of Elzie H. Taylor a/k/a/ E. H. Taylor.This lawsuit is to acquire an easement through eminent domain and the hearing referenced above is to determine the fair market value of the easement and any damages to the remainder if any. The easement being acquired is generally described as "Being a 0.0089 acre (386 Square Foot (SQ. FT.)) tract of land located in the F. McNaughton Survey, Abstract No. 392, Montgomery County, Texas, also being out of and a part of the remainder of a called 32-34/100 acre tract of land, as deeded to E.H.
