On June 3, 2020, Plaintiff Matthew Todd Anices, filed his Motion for Substituted Service on Defendant Hector Javier Carranza Pursuant to Rule 109 of the Texas Rules of Civil Procedure (hereinafter referred to as “the Motion”). In the Motion, Plaintiff moved the Court for an Order granting substituted service by publication on Defendant Hector Javier Carranza (hereinafter referred to as “Defendant Carranza”), who had evaded service and whose present whereabouts are unknown. - As described in the Motion, Plaintiff named Defendant Carranza in his Amended Petition 0n September 30, 2019. Despite the extraordinary efforts made, Plaintiff was unsuccessful in the multiple attempts to serve and locate Defendant Carranza. The numerous attempts to serve and locate Defendant Carranza following the issuance of the citation on October 2, 2019 are listed in'the Motion. The attempts t locate Defendant Carranza did not stop there. In fact, after successfully serving Defendant Elvin Oneil Lopez Izaguirre, Plaintiff’s process server inquired Whether Defendant Izaguirre knew the whereabouts of Defendant Carranza. As with the previous efforts, this too was unsuccessful. On May 15, 2020, I Plaintiff’s counsel ran a search through the Department of Defense Manpower Data Center to ascertain Defendant Carranza’s military status and learned that he was not an active duty member of the military. ' The Order Granting Plaintiff’s Motion for Substituted Service on Defendant Hector Javier Carranza was signed on June 11, 2020. Soon thereafter; Plaintiff submitted a formal Request for Citation by Publication along with the Issuance/Service by Publication fee to the Court.
