ITATION BY PUBLICATION – Rule 114 & 109 – Rules of Civil Procedure RUN ONCE A WEEK FOR FOUR (4) CONSECUTIVE WEEKS TO: JACK S PETERSON NOTICE TO RESPONDENT: “You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty two days after you were served this citation and petition, a default judgment may be taken against you.” GREETING: You are hereby commanded to appear by filing a written answer to the ORIGINAL PETITION at or before 10:00 o’clock a.m. of the first Monday after the expiration of 42 days from the date of issuance of this citation, the same being Monday the 9th day of November, 2020 at or before 10 o’clock a.m., before the Honorable Dan K Wilson in the County Court At Law 5 in Collin County, at the Courthouse in McKinney, Texas. Said ORIGINAL PETITION was filed on December 02, 2019 in this case, numbered 005-03852-2019 on the docket of said court, and styled: NAVY FEDERAL CREDIT UNION VS. JACK S PETERSON. The names of the parties to the cause are as follows: NAVY FEDERAL CREDIT UNION are Plaintiff(s) and JACK S PETERSON are Defendant(s). A brief statement of the nature of the suit is as follows, to-wit; Navy Federal Credit Union, its successors and assigns, by and through its attorney of record, Brian G. Sayer of The Sayer Law Group, P.C., 925 E. 4th Street, Waterloo, IA 50703, brought suit against Jack S Peterson, to declare and enter judgment, that Plaintiff is the originator and current debt owner with right to enforce the subject Credit Card Agreement originated on or about December 28, 2015 in the amount of $4,516.85 and Line of Credit Agreement originated on November 22, 2015 in the amount of $24,482.21, shown by ORIGINAL PETITION on file in this suit. If this citation is not served within ninety days after the date of its issuance, it shall be returned unexecuted. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates thereof, and make due return as the law directs.
