No. 20200464PR1 County Court of McLennan County, Texas On the 24th day of September, 2020, Applicant, Robert D. Gilbert, filed an Application to Determine Heirship and furnishes the following information to the Court: Paul Alan Lakemper (“Decedent”) died on or about June 28, 2020, which is the date he was found dead, at the age of 59 years, in Waco, McLennan County, Texas. No administration is pending upon Decedent’s Estate and none is necessary at this time. It is in the best interest of the Estate for the Court to determine who are the heirs and only heirs of the Decedent before an administration of the Estate occurs. The Court has jurisdiction and venue is proper because this is the Court where venue would be proper for the commencement of an administration under Section 33.001 of the Texas Estates Code and no will has been probated and no administration of the Decedent’s Estate has been granted. Applicant is a party seeking the appointment to be independent administrator under Section 401.003 of the Texas Estates Code. The names and residences of all of Decedent’s heirs, the relationship of each heir to Decedent and the true interest of the Applicant and of each of the heirs in the Estate of Decedent are as follows: Dorothy Elane Lakemper Hussemann, an Adult, Washburn, IL 61570, Half-Sister, Share of Real Property: 10%, Share of Personal Property: 10%; Jane Marie Lakemper Aussieker, an Adult, Varna, IL 61375-9473, Half-Sister, Share of Real Property: 10%, Share of Personal Property: 10%; John Carl Bruell, an Adult, Varna, IL 61375-8959, Half-Brother, Share of Real Property: 10%, Share of Personal Property: 10%; Charles Edward Bruell, an Adult, Sparland, IL 61565, Half-Brother, Share of Real Property: 10%, Share of Personal Property: 10%; Larry Eugene Bruell, an Adult, East Peoria, IL 61611, Half-Brother, Share of Real Property: 10%, Share of Personal Property: 10%. At the time of Decedent’s death, Decedent owned real property in the State of Texas and personal property as follows: Real Property: Description: 5.0 acres in the I. Decedent was not survived by any living child. Decedent was not predeceased by any child. Decedent was married one time to Patsy Sue Giles Lakemper on June 24, 1989 and they were married as of the date of death of Patsy Sue Giles Lakemper. All children born to or adopted by Decedent have been listed. Each marriage of Decedent has been listed. To the best of knowledge, Decedent died intestate. The Application does not omit any information required by the Texas Estates Code, Sections 202.004, 202.005, 202.007 and 202.008, except as follows: None. There are debts owed by Decedent that are not secured by liens upon real estate and there is a necessity of an administration of this Estate and an application to appoint an independent administrator for that purpose under Section 401.003 will be filed following the determination by the Court of the heirs of this Estate. The Application contains all of the material facts and circumstances within the knowledge and information of the Applicant that might reasonably tend to show the time or place of death or the names or residences of all heirs, if the time or place of death or the names residences of all the heirs are definitely known to the Applicant, except as follows: None. Applicant prays that citation be issued as required by law; that an attorney ad litem be appointed to represent the interests of heirs whose names and/or locations are unknown and any incapacitated heir upon a finding that the appointment is necessary to protect the interests of that heir; that upon hearing hereof, the Court determine who are the heirs and only heirs of Decedent and their respective shares and interests in this Estate; and that no necessity exists for an administration of Decedent’s Estate. Said Application will be heard and acted on by said Court at 10:00 a.m. on the first Monday next after the expiration of ten days from date of publishing this citation, the same being the 10/19/2020 at the Courthouse thereof in Waco, McLennan County, Texas, at which time and place all persons interested in this Application to Determine Heirship, are hereby cited and required to appear by filing a written answer and contest to said application.
