THE STATE OF TEXAS To any Sheriff or any Constable within the State of Texas-----GREETING: YOU ARE HEREBY COMMANDED to cause to be published, ONCE, not less than ten days before the return day thereof, exclusive of the date of publication, in a newspaper of general circulation printed and/or published in McLennan County, Texas, the accompanying citation, of which the herein below is a true copy. __________________________________________________________________________________________ CITATION BY PUBLICATION THE STATE OF TEXAS TO ALL PERSONS INTERESTED IN THE ESTATE of DONALD MONROE WALTERS, deceased; TO ANY UNKNOWN HEIRS of DONALD MONROE WALTERS, deceased; TO ANY NON-RESIDENT HEIRS of DONALD MONROE WALTERS, deceased; and TO ANY HEIRS of DONALD MONROE WALTERS, deceased, WITHOUT THE STATE OF TEXAS. No. 20200480PR1 County Court of McLennan County, Texas On the 1st day of October, 2020, Donald M. Walters, Jr. (“Applicant”), filed an Application For The Determination Of Heirship furnishing the following information to the Court: Donald Monroe Walters (“Decedent”) died on June 9, 2020, in Waco, McLennan County, Texas at the age of 95 years. Applicant is an individual interested in this Estate. The Court has jurisdiction and venue because Decedent was domiciled and had a fixed place of residence in this County on the date of death. Decedent owned real and personal property described generally as cash and assorted personal effects of a probable value in excess of $50,000. To the best knowledge, Decedent died intestate. Decedent was married once to Goldwyn Muzette Walters, who predeceased the Decedent on June 20, 2019. Decedent and Goldwyn Muzette Walters had two children, whose names are Donald M. Walters, Jr. and David Allen Walters. These are the only two children born to the Decedent. The names and addresses of all Decedent’s heirs, the relationship of each heir to Decedent, whether each heir is an adult or a minor, and the true interest of Applicant and of each of the heirs in the Estate of the Decedent are as follows: Donald M. Walters, Jr. of Austin, Texas, Adult, Son, 50% interest in the Estate and David Allen Walters, last known address in Austin, Texas, Adult, Son, 50% interest in the Estate. It is necessary and in the best interest of the Estate for the Court to determine who are the heirs and the only heirs of the Decedent. The Application states that it does not omit any information required by the Estate Code 202.005 . Applicant has prosecuted this proceeding in good faith, and with just cause, for the purposes of having Decedent’s heirship determined and opening an administration on Decedent’s Estate. There is no need for the appointment of appraisers. Applicant prays that citation issue as required by law; that upon hearing hereof, the Court determine who are the heirs and only heirs of Decedent and their respective shares and interests in this Estate; that the Court appoint an Attorney Ad Litem to represent the interests of the Decedent’s unknown heirs; that appraisers not be appointed; and that all other Orders be entered as the Court may deem proper. Said Application will be heard and acted on by said Court at 10:00 a.m. on the first Monday next after the expiration of ten days from date of publishing this citation, the same being the 10/26/2020 at the Courthouse thereof in Waco, McLennan County, Texas, at which time and place all persons interested in this Application for the Determination of Heirship, are hereby cited and required to appear by filing a written answer and contest to said application.
