Montgomery County, Texas filed a Plaintiff’s Amended Original Petition and Statement in Condemnation with the Judge of the County Court at Law No. 2 of Montgomery County, Texas, on the 10TH day of July, 2020, in Cause No. 19-11-15734 which is styled Montgomery County, Texas vs. Mark a. Novosad, Laura A. Novosad, Portfolio Recovery Associates LLC, Assignee of GE Capital Retail Bank (Care Credit), et al. The Plaintiff is Montgomery County, Texas. The Defendants are: MARK NOVOSAD, LAURA D. NOVOSAD, PORTFOLIO RECOVERY ASSOCIATES LLC, LINDA TADLOCK LEWIS, DARLA SUE LEXINGTON, TERRY LEA PHILLIPS CATES, ESTATE OF SHIRLEY DALE ROBERTS, DECEASED AND THE UNKNOWN HEIRS OF SHIRLEY DALE ROBERTS WHOSE IDENTITY AND WHEREABOUTS ARE UNKNOWN, AND, IF ANY OF THEM BE DECEASED, THEIR RESPECTIVE HEIRS AND LEGAL REPRESENTATIVES, IF ANY; SHIRLEY DALE ROBERTS. This suit is an eminent domain proceeding in which the Montgomery County, Texas is condemning a tract of land located in Being 0.088 acres, more or less, being a portion of Lots 26 and 27, Block 4 of Pioneer Trails, Section 1, an unrecorded subdivision in the J. F. Springfield Survey (also known as the T. and N.O.R.R. Survey Number 12), Abstract No. 749, Montgomery County, Texas such property being fully described in Exhibit “A” of Plaintiff’s Amended Original Petition and Statement in Condemnation filed under the above referenced cause number. The interests of these Defendants are that they either own or claim an interest in said property, subject to unpaid accrued taxes. You are further notified that you may appear at the hearing before the Special Commissioners and present evidence you desire on the issue of damages to be assessed against Montgomery County, Texas. If you do not appear at the hearing, the Special Commissioners may proceed to assess the damages of the owner of the property being condemned. as is more fully shown by Plaintiff's Amended Original Petition and Statement of Condemnation on file in this suit.
