Monday, the 23RD NOVEMBER, 2020, being the Monday next after the expiration date of forty-two days after this citation is issued, and you are hereby commanded and required then and there to appear and file written answer to the PLAINTIFF’S ORIGINAL PETITION, filed in said Court on the 15TH day of APRIL, 2020 in a suit numbered 2020-23660 on the docket of said court, wherein ARTURO G. ROMERO is Plaintiff(s) and VIVIANA G. PENA (AKA VIVIAN A. PENA), EVAN S HOWELL AND THE ESTATE OF JO KING REID AND ALL HEIRS OF JO KING REID are Defendant(s), the nature of plaintiff’s demand being and the said petition alleging: To the heirs of Jo King Reid – you are hereby notified and served with the following lawsuit: By Quitclaim Deed dated January 15, 2001, Viviana G. Pena conveyed title to the real property located at 4606 Woodside, Houston, Texas 77023, (the “Property”) to Evan S. Howell, (File Number U842138 Film Code Number 536902541, in the Official Public Records of Real Property of Harris County, Texas). The legal Description for the Property is: Lot Two (2) in Block Thirty Four (34), Eastwood, a subdivision in Harris County, Texas, according to the Map or Plat thereof recorded in Volume 4, Page 42 of the Map Records of Harris County, Texas, more commonly known as 4606 Woodside, Houston, Texas 77023. Howell conveyed the Property to Arturo G. Romero. The lawsuit, Cause No. 2020-23660, Arturo G. Romero v. Viviana G. Pena, aka Vivian A. Pena, Evan S. Howell, the Estate of Jo King Reid, and all Heirs of Jo King Reid, In the 11th District Court of Harris County, Texas, seeks to clear title for the benefit of Arturo G. Romero, as a question exists as to how Vivianna G. Pena originally acquired the Property from Jo King Reid, who appears to be previous owner (from 1988 to 2001). To that end, a deed exists in which Mayon and Lucille Hicks conveyed the Property to Willie Juanita King on February 27, 1956. On even date, Willie Juanita King executed a Declaration of Trust, which shows that the Property was left to her daughter, Jo King Reid, upon Willie Juanita King’s death. Willie Juanita King passed away on October 4, 1988, according to her Certificate of Death, on which Ms. Reid is referred to as the informant. Jo King Reid passed away on December 15, 2010, without heirs. Notice hereof shall be given by publishing this Citation once a week for four consecutive weeks previous to the 23RD day of NOVEMBER, 2020, in some newspaper published in the County of HARRIS, if there be a newspaper published therein, but if not, then the nearest county where a newspaper is published, and this Citation shall be returned on the 19TH day of NOVEMBER, 2020, which is forty two days after the date it is issued, and the first publication shall be at least twenty-eight days before said return day. HEREIN FAIL NOT, but have before said court on said return day this Writ with your return thereon, showing how you have executed same.
