You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 am on the Monday next following the expiration of 42 days after the date this citation was issued, a default judgment may be taken against you." PROPERTY DESCRIPTION: containing 29.46 acre (1,283,272 square foot) parcel of land, situated in the G. Jameson Survey, Abstract 41, Polk County, Texas, being a portion of a 4 acre tract of land described as “Parcel Two”, conveyed from John Vernon Cobb to John Walter Cobb, et ux, by Gift Deed, dated May 19, 2003, as recorded in Volume 1327, Page 960, of the Official Public Records of Polk County, Texas (O.P.R.P.C.T.), and also being a portion of a 69 acre tract of land described as “Parcel Three”, conveyed from John Vernon Cobb to John Walter Cobb, et ux, by Gift Deed, dated May 19, 2003, as recorded in Volume 1327, Page 960, of the O.P.R.P.C.T., said 29.46 acre such property being fully described in Exhibit “A” of Plaintiff’s Petition for Condemnation filed under the above-referenced cause number. You are hereby commanded to appear by filing a written answer to the PETITION FOR CONDEMNATION at or before 10:00 o'clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation the same being December 7th, 2020, before the Honorable County Court at Law of Polk County, at the Courthouse in said County in Livingston, Texas. Said PETITION FOR CONDEMNATION was filed in said court on the 17th day of December, 2019 in the above entitled cause. A brief statement of the nature of this suit is as follows, to-wit: This is a statutory condemnation case in which the State seeks to acquire the fee simple title to the property identified in “Exhibit A” of the State’s Petition for Condemnation pursuant to its sovereign right of eminent domain.
