Defendants- GREETING NOTICE TO DEFENDANTS: "You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 am on the Monday next following the expiration of 42 days after the date you were served this citation and petition, a default judgment may be taken against you. In addition to filing a written answer with the clerk, you may be required to make initial disclosures to the other parties of this suit. TRCP. 99 You are hereby commanded to appear by filing a written answer to the Plaintiffs’ First Amended Petition at or before 10:00 o'clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation the same being Monday APRIL 24, 2023, before the Honorable 81st District Court of Wilson County, at the District Court Justice Center in said County in Floresville, Texas. Plaintiffs’ Original Petition was filed in said court by Dennis Arriaga (attorney for Plaintiffs), whose address is 2206 Highway 35 N., Port Lavaca, Texas 77979 on the 21st day of OCTOBER 2022, and said Plaintiff’s First Amended Petition was filed in said court by Dennis Arriaga on the 22nd day of February 2023, in the above-entitled Cause. A brief statement of the nature of this suit is as follows, to-wit: This action is one for trespass to try title under Chapter 22 of the Texas Property Code, and Rules 783 et seq., of the Texas Rules of Civil Procedure, to quiet title on real property pursuant to Article V, Section 8 of the Texas Constitution and Section 26.043(8) of the Texas Government Code and to partly partition the property under Chapter 23 of the Texas Property Code, and Rules 756 et seq., of the Texas Rules of Civil Procedure and concerns title to and ownership of real estate more fully described in a Warranty Deed from A.B. Frank to John Notzon and his wife, Josephine Notzon, dated November 19, 1900, recorded in Volume 46, Page 409, of the Official Public Records of Wilson County, Texas. The property is a tract of two hundred and one + 1/2 (201 ½) acres of land out of Survey No. 66, originally granted to S.S. Saunders, Certificate No. 204, Abstract No. 309.
