The petition of HECTOR VARELA, GLADIS C. VARELA AND ANDRE L. VARELA, Plaintiff, was filed against HASKEL WHITESIDE, DAIANE HOLLINGSWORTH, REVA MAE WHITESIDE, LEONARA TRYON, ELIZABETH WHITESIDE, GLENN D. WHITESIDE and HENRY LEE WHITESIDE, Defendant, on March 14, 2014, in the 142nd Judicial District Court of Midland County, Texas, and is numbered CV50142, and entitled HECTOR VARELA, GLADIS C. VARELA AND ANDRE L. VARELA V. HASKEL WHITESIDE, DAIANE HOLLINGSWORTH, REVA MAE WHITESIDE, LEONARA TRYON, ELIZABETH WHITESIDE, GLENN D. WHITESIDE and HENRY LEE WHITESIDE. This lawsuit is a partition for real property, a trespass to try title and other equitable remedies. On June 2012, the Plaintiff paid HASKEL WHITESIDE, Jr., accepted $2,000 in exchange for his interest in the real property. DAIANE HOLLINGSWORTH, REVA MAE WHITESIDE, LEONARA TRYON, ELIZABETH WHITESIDE, GLENN D. WHITESIDE and HENRY LEE WHITESIDE have refused attempts to be served and to settle the matter. The heirs have failed to pay ad valorem taxes for the real property. The legal description of the Real Property is as follows: The North Eighty Feet (88) of Block Twelve ( 12), MORNINGSIDE ADDITION , AN ADDITION to the City of Midland, Midland County, Texas, according to the map or phat thereof record in Volume 84, Page 397 Deed Records of Midland County, Texas; The street address is 2305 N. Main, Midland TX 79701. The Plaintiff is seeking legal title to the real property in question. Failure to respond to this lawsuit will result in a judgment in favor of the Plaintiff. The Court has authority in this suit to enter any judgment or decree in the Plaintiff s interest which will be binding upon you.
