NOTICE OF SPECIAL COMMISSIONERS HEARING To: John Mouton Guadalupe Delagarza, Sr. Guadalupe Delagarza, Jr. Please take notice that, as indicated below, the undersigned Special Commissioners will meet and proceed to hear evidence from all parties so as to enable them to fix the value of and to assess the damages, if any, occasioned by the condemnation of the property as prayed for and described in the copy of Plaintiff’s Original Petition in Cause Number CI61491, Brazoria County, Texas. v. Sam Rossi, Jr., et al., in the County Court at Law No. 3 and Probate Court, Brazoria County, Texas. Your disclosure of such appraisal report(s) to the acquiring governmental entity shall take place within ten (10) days of receipt of appraisal reports but no later than three (3) days prior to the Special Commissioners’ hearing. Brazoria County, Texas, filed a petition for condemnation with the Judge of County Court at Law No. 3 and Probate Court, Brazoria County, Texas on June 30, 2020, in Cause No. CI61491, which is styled Brazoria County, Texas v. Sam Rossi, Jr., et al. The plaintiff is Brazoria County, Texas. The defendants are Sam Rossi, Jr.; Dorsi Lee Rossi; John Mouton; Michael T. Robinson; Guadalupe Delagarza, Jr.; Guadalupe Delagarza, Sr.; Anna Delagarza; Jay Ivy; Alvin Independent School District; Alvin Community College; Brazoria County General Fund; Brazoria County Special Road and Bridge Fund; Brazoria County Emergency Services District Number 3; Brazoria County Conservation and Reclamation District Number 3; and Brazoria County Drainage District Number 4. The interests of these defendants is either ownership or a claim of interest in the real property, subject to any unpaid accrued taxes. The name and address of the attorney for Plaintiff is Jesse M. Blakley, Jr., Brazoria County Criminal District Attorney’s Office, 111 East Locust St., Suite 513A, Angleton, Texas 77515. This suit is an eminent domain proceeding in which Plaintiff is acquiring a tract of land located in Brazoria County, Texas, which is described as follows: A 0.3755-acre (16,357 sq. ft.) tract of land situated in the E. Little Survey, A-320, Brazoria County, Texas. Said 0.3755-acre tract being out of a 7.966-acre (Calc.) tract conveyed by deed to Sam Rossi Jr. and wife Doris Lee Rossi as recorded under B.C.C.F. No. 2010048819, of the Official Public Records of Brazoria County (O.P.R.B.C.), Texas, such property being fully described in Plaintiff’s Original Petition. You may appear at the hearing before the Special Commissioners and present evidence on the issue of damages to be assessed against Plaintiff. If you do not appear at the hearing, the Special Commissioners may proceed to asses the damages to the owners of the property being condemned. ISSUED on October 27, 2020.
