Monday, the 4TH day of JANUARY, 2021, being the Monday next after the expiration date of forty-two days after this citation is issued, and you are hereby commanded and required then and there to appear and file written answer to the PLAINTIFFS’ SECOND AMENDED ORIGINAL PETITION, filed in said Court on the NOVEMBER 3, 2020, in a suit numbered 2019-28724 docket of said court, wherein JOE D. GARCIA, INDIVIDUALLY AND NEXT FRIEND OF JDG, A MINOR, the Plaintiffs, and, JOSE REYES, the Defendant, the nature of plaintiff’s demand and the said petition alleging: Motor Vehicle Accident SYNOPSIS Cause No. 2019-28724; Joe D. Garcia, Individually and next friend of JDG, a minor, Plaintiffs vs. Jose Reyes , Defendant; in the 189th Judicial District Court of Harrs County, Texas. This suit is brought to collect a legal debt of money damages owing to JOE D. GARCIA and his daughter, JDG, a minor, by reason of an occurance that took place at the 700 block of Beltway 8 West at or near the 10,600 block of Ella, in Houston, Harris County, Texas on March 30, 2018, when a vehicle driven by defendant, JOSE REYES, failed to safely change lane and collided with the vehicle the Plaintiffs were occupying. The crash was so severe that the impact caused the Plaintffs’ vehicle to be a total loss. The accident caused bodily injuries to Plaintiffs. See attached copy of Police Report. Notice hereof shall be given by publishing this Citation once a week for four consecutive weeks previous to the day of JANUARY 4, 2021, in some newspaper published in the County of Harris, if there be a newspaper published therein, but if not, then the nearest county where a newspaper is published, and this Citation shall be returned on the 29TH day of December, 2020, which is forty two days after the date it is issued, and the first publication shall be at least twenty-eight days before said return day. HEREIN FAIL NOT, but have before said court on said return day this Writ with your return thereon, showing how you have executed same.
