SUMMARY This lawsuit is a Rescission of Statutory Lien suit against the known and unknown heirs of Charli Pope Childres, Deceased, and based upon a default under the Note and Security Instrument securing Plaintiff’s interest in the property legally described as: LOT THIRTY SIX (36), IN BLOCK THIRTY FIVE (35), OF FOREST COVE, SECTION (7), AN UNRECORDED SUBDIVISION IN HARRIS COUNTY, TEXAS AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS; BEING A TRACT OR PARCEL CONTAINING 0.3099 ACRE OF LAND BEING LOT 36, BLOCK 35 OF FOREST COVE, SECTION 7 AN UNRECORDED SUBDIVISION SITUATED IN THE MARY OWENS SURVEY, ABSTRACT NUMBER 611, HARRIS COUNTY, TEXAS, BEING THAT SAME TRACT OF RECORD UNDER HARRIS COUNTY CLERK'S FILED NUMBER (H.C.C.F. NO.) M341815 SAID 0.3099 ACRE TRACT BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS WITH ALL BEARINGS REFERENCED TO SAID LOT 36: BEGINNING AT AN IRON ROD FOUND FOR THE COMMON NORTHWEST CORNER TO SAID LOT 36, THE HEREIN DESCRIBED TRACT, THE NORTHEAS CORNER TO THAT CERTAIN TRACT (LOT 35) OF RECORD UNDER H.C..C .F NO F691138, IN THE SOUTH RIGHT OF WAY LINE OF HILLTOP LANE (60 FEET WIDE); THENCE, SOUTH 88 DEGREES 35 FEET 59 INCHES EAST, ALONG SAID SOUTH RIGHT OF WAY LINE, 90.00 FEET TO AN IRON ROD FOR THE COMMON NORTHEST CORNER TO SAID LOT 36, THE HEREIN DESCRIBED TRACT AND THE NORHTWEST CORNER TO THAT CERTAIN TRACT (LOT 37) OF RECORD UNDER H.C.C.F NO C123771; THENCE SOUTH 01 DEGREES 24 FEET 01 INCHES WEST, 150.00 FEET TO A FENCE CORNER FOUND FOR THE COMMON SOUTHEAST CORNER TO SAID LOT 36, THE HEREIN DESCRIBED TRACT AND THE SOUTHWEST CORNER TO SAID LOT 37; THENCE NORTH 88 DEGRESS 35 FEET 59 INCHES WEST, 90.00 FEET TO A FENCE CORNER FOUND FOR THE COMMON SOUTHWEST CORNER TO SAID LOT 36, THE HEREIN DESCRIBED TRACT AND THE SOUTHEAST CORNER TO SAID LOT 35; THENCE NORTH 01 DEGRESS 24 FEET 01 INCHES EAST, 150.00 FEET TO THE POINT OF BEGINNING AND CONTAINING 0.3099 ACRE OF LAND. and commonly known as 1710 Hill Top Lane, Kingwood, Texas 77339. Notice hereof shall be given by publishing this Citation once a week for four consecutive weeks previous to the day of JANUARY 4, 2021, in some newspaper published in the County of Harris, if there be a newspaper published therein, but if not, then the nearest county where a newspaper is published, and this Citation shall be returned on the DECEMBER 29 2020, which is forty two days after the date it is issued, and the first publication shall be at least twenty-eight days before said return day.
