Monday, the 4TH day of JANUARY, 2021, being the Monday next after the expiration date of forty-two days after this citation is issued, and you are hereby commanded and required then and there to appear and file written answer to the PLAINTIFFS’ THIRD AMENDED ORIGINAL PETITION AND REQUEST FOR DISCLOSURE, filed in said Court on the SEPTEMBER 11, 2020, in a suit numbered 2020-28011 docket of said court, wherein JOSE LUIS GARCIA AND MAGDALENA GARCIA , the Plaintiffs, and, ALAIN ULACIA AND DIAZ CONCRETE, LLC; AND D&D READY MIX CONCRETE, LLC, the Defendant, the nature of plaintiff’s demand and the said petition alleging: Motor Vehicle Accident SYNOPSIS This lawsuit arises out of an automobile collision. On August 22, 2018, Defendant, Alain Ulacia, was operating a 2005 White Sterling Truck, while in the course and scope of his employment with Defendants, Diaz Concrete LLC.; Edwin Steve Diaz Urias d/b/a Concrete, LLC; and/or D & D Ready Mix Concrete, L.L.C. Defendant, Alain Ulacia, was traveling westbound on S. Sam Houston PW W. service road when he ran a red light at the intersection of SH 288 service road, and crashed in Plaintiffs who were lawfully in the intersection on a green light traveling northbound on the SH 288 service road in a white 2005 Chevrolet Van. As a result of the crash, Plaintiffs suffered serious bodily injuries and damages. Notice hereof shall be given by publishing this Citation once a week for four consecutive weeks previous to the day of JANUARY 4, 2021, in some newspaper published in the County of Harris, if there be a newspaper published therein, but if not, then the nearest county where a newspaper is published, and this Citation shall be returned on the 30TH day of December, 2020, which is forty two days after the date it is issued, and the first publication shall be at least twenty-eight days before said return day. HEREIN FAIL NOT, but have before said court on said return day this Writ with your return thereon, showing how you have executed same.
