CITATION BY PUBLICATION – Rule 114 & 109 – Rules of Civil Procedure RUN ONCE A WEEK FOR FOUR (4) CONSECUTIVE WEEKS TO: DELIA R. SERRATO NOTICE TO RESPONDENT: “You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty two days after you were served this citation and petition, a default judgment may be taken against you.” GREETING: You are hereby commanded to appear by filing a written answer to PLAINTIFFS’ FIRST AMENDED PETITION WITH REQUEST FOR DISCLOSURE at or before 10:00 o’clock a.m. of the first Monday after the expiration of 42 days from the date of issuance of this citation, the same being Monday the 7th day of September, 2020 at or before 10 o’clock a.m., before the Honorable David Waddill in the County Court At Law 7 in Collin County, at the Courthouse in McKinney, Texas. Said PLAINTIFFS’ FIRST AMENDED PETITION WITH REQUEST FOR DISCLOSURE was filed on July 06, 2020 in this case, numbered 007-01099-2020 on the docket of said court, and styled: LARRY CROWE AND JO ANN HOUSTON VS. WADE SERRATO AND DELIA R. SERRATO AND ALEX ALEJANDRO ROMERO. The names of the parties to the cause are as follows: LARRY CROWE AND JO ANN HOUSTON are Plaintiff(s) and WADE SERRATO, DELIA R. SERRATO AND ALEX ALEJANDRO ROMERO are Defendant(s). A brief statement of the nature of the suit is as follows, to-wit; “On or about June 9, 2018, Plaintiffs were traveling within Interstate 75 within the right lane. Defendant was located within the left lane, in the same direction as Plaintiffs. Defendant made an improper lane change to the right, causing a collision into Plaintiff’s vehicle. Due to Defendant’s negligence, Plaintiffs suffered bodily injuries.” as is more fully shown by PLAINTIFFS’ FIRST AMENDED PETITION WITH REQUEST FOR DISCLOSURE on file in this suit. If this citation is not served within ninety days after the date of its issuance, it shall be returned unexecuted. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates thereof, and make due return as the law directs.
