BEFORE THE HONORABLE JUDGE OF THE 66th District Court OF HILL COUNTY, TEXAS, AT THE COURTHOUSE OF SAID COUNTY IN HILLSBORO, TEXAS. The suit is numbered CV483-20DC and the Plaintiff’s Petition was filed in the 66th District Court in Hill County, Texas on September 11, 2020, and styled: Federal National Mortgage Association vs. Justin Andrew Jolly, Brittany Krambeck, William Arnold Miller, Kerry Alan Miller Parties to the Suit: Plaintiff(s): Federal National Mortgage Association Defendant(s): Justin Andrew Jolly, Brittany Krambeck, William Arnold Miller, Kerry Alan Miller A brief statement of the nature of this suit is as follows, to wit: This is an in rem proceeding seeking a declaration that the Security Instrument covered Lot 7 and the Relevant Portion of Lot 6 and that at the August 4, 2020 foreclosure sale, Plaintiff acquired title to real property located at 1002 N. 17th Street, Temple Texas 76501, more particularly described as: TRACT ONE: ALL OF LOT 7 IN THE ORIGINAL TOWN OF HUBBARD, HILL COUNTY, TEXAS, ACCORDING TO THE PLAT RECORDED IN VOLUME 41, PAGE 14, DEED RECORDS, HILL COUNTY, TEXAS. TRACT TWO: All that certain lot, tract or parcel of land lying and situated in the Original Town of Hubbard, Hill County Texas, being all of Lot Six (6), Block 6, SAVE AND EXCEPT that portion of Lot 6 containing 0.20 acre, more particularly described on the survey plat and field notes prepared by Donald B. Szurgot, Registered Professional Land Surveyor dated August 9, 2005 marked Exhibit A which is attached hereto and made a part hereof for all purposes. EXHIBIT A: All that certain lot, tract or parcel of land lying and situated in Hill County, Texas, being a part of Lot 6, Block 6 in the Original Town of Hubbard, Hill County, Texas, according to the plat recorded in Volume 41 Page 14 of the deed records of Hill County, Texas, and being a part of the same tract of land described in the deed from James Cypert, Attorney in fact for Geneva Cypert Hill to Johnnie G. Boyd and wife, Laverne Boyd dated February 20, 2004, recorded in Volume 1287, Page 514 of the Deed Records of Hill County; Texas, and being more particularly described by metes bounds as follows: BEGINNING at a 5/8 inch iron rod set at a corner, said corner bears North 45 degrees 00 minutes 00 seconds East 75.00 feet and South 45 degrees 00 minutes 00 seconds East 150.00 feet from a 5/8 inch iron rod found at the Northwesterly corner of Lot 4, Block 6 of said Town, a control monument; THENCE North 45 degrees 00 minutes 00 seconds East 57.85 feet to a 5/8 inch iron rod set at a corner; THENCE South 44 degrees 31 minutes 08 seconds East 150.01 feet to a 5/8 inch iron rod set at a corner, lying in the Northerly line of 5th Street; THENCE South 45 degrees 00 minutes 00 seconds West 56.59 feet along said Northerly line of 6th Street to a 5/8 inch iron rod set at a corner; THENCE North 45 degrees 00 minutes 00 seconds West 150.00 feet to the point of beginning and containing .20 acres of land more or less. as is more fully shown by Plaintiff’s Petition on file in this suit.
