TO: Home Equity Loan Corporation DEFENDANT GREETINGS: YOU ARE HEREBY COMMANDED to appear and answer before the Honorable Carson Campbell Court, Bastrop County, Texas, at the Courthouse of said county in Bastrop Texas, by filing a written answer at or before 10 o'clock A.M. of the first Monday next after the expiration of forty-two days from the date of the issuance of this citation, same being the 18th day of February, 2021, to PLAINTIFFS ORIGINAL PETITION FOR DECLATORY JUDGMENT filed in said court, on the 28th day of August, 2020, in this cause, numbered 1602-21 on the docket of said court and styled: CitiMortgage, Inc. vs. Josephine A Morales aka Napolez, Home Equity Loan Corporation, Credit Corp Solutions, Inc., LVNV Funding, LLC A brief statement of the nature of this suit is as follows, to-wit: Plaintiff CitiMortgage, Inc., its successors and assigns by and through its attorney of record, Brian G. Sayer of The Sayer Law Group, P.C., 925 E. 4th Street, Waterloo, IA 50703, brought suit against Home Equity Mortgage Corporation, to declare and enter judgment that Plaintiff is the current holder with right to enforce the Deed of Trust and has a superior valid lien against the property located at 1030 FM 1441 Unit A, Bastrop, Texas 78602 and legally described as: Being a 2.105 acres tract, lot, or parcel of land out of and being a part of the BASTROP TOWN TRACT, A-11, in Bastrop County, Texas and being a part of Lot No. 44, CIRCLE "D" COUNTRY ACRES, Section 2, a subdivision in said County as recorded in Plat Cabinet No. 1, Page 55-B, Bastrop County Plat Records. Herein described 2.105 acre tract or parcel being more particularly described by metes and bounds as follows: BEGINNING at an iron rod found in the south or southeast line of Lot No. 47, the west or northwest corner of Lot No. 45, the north or northeast corner of Lot No. 44 for the most northerly corner of this tract. THENCE with the common line of Lots No. 44 and 45, S 46° 50° 09" E, 488.39 feet to an iron rod found in the north or northwest line of Lot No. 43, the south corner of Lot No. 45, the east corner of Lot No. 44 for the most easterly corner of this tract. THENCE with the common line of Lots No. 43 and 44, S 66° 03' 44" W, 407.67 feet to an iron rod found for the west or southwest corner of this tract. THENCE crossing said Lot No. 44, N 01° 52' 39" E, 499.78 feet to The POINT OF BEGINNING, containing 2.105 acres of land. If this citation is not served within ninety days after the date of its issuance, it shall be returned unserved.
