TROUSDALE, JR., DECEASED, WHOSE NAMES AND WHEREABOUTS ARE UNKNOWN; AND THE UNKNOWN HEIRS OF MAXINE TROUSDALE EDMONDS, DECEASED WHOSE NAMES AND WHEREABOUTS ARE UNKNOWN You are each hereby notified that a hearing will be held at 10:00 o’clock a.m., on the first Monday after the expiration of forty-two (42) days from the date of issuance hereof, that is to say Monday, the __15th__ day of ____March____, 2021, to assess the damages of the owner of the property being condemned. Daniel Simnacher, Trustee of the Daniel Simnacher Exempt Lifetime Trust, created under the Last Will and Testament of Leona Simnacher, deceased, et al.. The Plaintiff is the State of Texas. The Defendants are: The Unknown Heirs of James W. Trousdale, Jr., deceased, whose names and whereabouts are unknown; and The Unknown Heirs of Maxine Trousdale Edmonds, deceased whose names and whereabouts are unknown, and, if any of them be deceased, their respective heirs and legal representatives, if any; Daniel Simnacher, Trustee of the Daniel Simnacher Exempt Lifetime Trust, created under the Last Will and Testament of Leona Simnacher, deceased; Daniel Simnacher, Trustee of the Daniel Simnacher Exempt Lifetime Trust, created under the Last Will and Testament of Larry Simnacher, deceased; Lisa Simnacher, Trustee of the Lisa Simnacher Exempt Lifetime Trust created under the Last Will and Testament of Leona Simnacher, deceased; Lisa Simnacher, Trustee of the Lisa Simnacher Exempt Lifetime Trust, created under the Last Will and Testament of Larry Simnacher, deceased; Weldon W. This suit is an eminent domain proceeding in which the State of Texas is condemning a tract of land located in Liberty County, Texas, containing 109.7 acre (4,776,947 square feet) parcel of land situated in the Angus McNeil, Abstract Number 77, Liberty County, Texas, and being part of a calculated 3,147.431 acre tract of land described as Tract One and part of a called 160.00 acre tract of land described as Tract Two both from Velma Burr Staten, Independent Executrix of the Estate of Larry Simnacher, deceased to Daniel Simnacher Exempt Lifetime Trust and Lisa Simnacher Exempt Lifetime Trust, both created under the Last Will and Testament of Larry Simnacher, deceased, and in equal shares by deed executed January 22, 2018, as recorded in County Clerk’s File Number 2018001743 of the Official Public Records of Liberty County, Texas (O.P.R.L.C.T.) and part of the same aforementioned calculated 3,147.431 acre tract of land described as Tract One from Velma Burr Staten, Successor Trustee of the Leona Simnacher Exempt Bypass Trust created under the Last Will and Testament of Leona Simnacher, deceased to Daniel Simnacher Exempt Lifetime Trust and Lisa Simnacher Exempt Lifetime Trust, both created under the Last Will and Testament of Leona Simnacher, deceased, and in equal shares by deed executed January 22, 2018, as recorded in County Clerk’s File Number 2018001744, O.P.R.L.C.T., and being part of Lots 14 thru 22 and 24 thru 26 of ANGUS MCNEIL LEAGUE, an addition to Liberty County, Texas, as recorded in Volume P, Page 199 and Volume 2, Page 65 of the Deed Records of Liberty County, Texas (D.R.L.C.T.), and being part of Lots 3 and 30 of A.W. WRIGHT SUBDIVISION, an addition to Liberty County, Texas, as recorded in Volume 37, Page 4, D.R.L.C.T such property being fully described in Exhibit “A” of Plaintiff’s Petition for Condemnation filed under the above-referenced cause number. The interests of these Defendants are that they either own or claim an interest in said property, subject to unpaid accrued taxes. You are further notified that you may appear at the hearing before the Special Commissioners and present evidence you desire on the issue of damages to be assessed against the State. If you do not appear at the hearing, the Special Commissioners may proceed to assess the damages of the owner of the property being condemned. If this Notice is not served within ninety (90) days after its issuance, it shall be returned forthwith.
