YOU ARE HEREBY COMMANDED to be and appear before the 11TH Judicial District Court of Harris County, Texas in the Courthouse in the city of Houston, Texas at or before 10:00 o’clock A.M. Monday, the 29TH MARCH, 2021, being the Monday next after the expiration date of forty-two days after this citation is issued, and you are hereby commanded and required then and there to appear and file written answer to the PLAINTIFF’S ORIGINAL PETITION, filed in said Court on the 9TH day of MARCH, 2020 in a suit numbered 2020-15906 on the docket of said court, wherein ELIZABETH CONTRERAS is Plaintiff(s) and SANTIAGO JESUS DIAZ GUTIERREZ is Defendant(s), the nature of plaintiff’s demand being and the said petition alleging: On or about June 8, 2018 a motor vehicle accident involving Plaintiff Elizabeth Contreras and Defendants Santiago Jesus Diaz Gutierrez occurred as follows: there were three vehicles involved and they all were travelling North bound in the 4200 block of North FWY. A Non-Party was the driver of a vehicle travelling behind Plaintiff’s vehicle. Defendant, Santiago Jesus Diaz Gutierrez was the driver of the last vehicle behind Non-Party’s vehicle. Plaintiff stopped due to heavy traffic in front of her when suddenly Defendant Santiago Jesus Diaz Gutierrez failed to control his speed, failed to maintain a safe distance and collided violently with the rear end of the middle vehicle and caused that vehicle to strike the Plaintiff’s vehicle. Defendant Santiago Jesus Diaz Gutierrez was issued a citation by the Harris County Sheriff’s Office for failing to control speed. The identity and whereabouts of Defendant Santiago Jesus Diaz Gutierrez was determined by the information given to the Harris County Sheriff’s Office at the accident scene. As a direct result of Defendants Santiago Jesus Diaz Gutierrez’s negligence, Plaintiff was caused to suffer damages and injuries. Notice hereof shall be given by publishing this Citation for four consecutive weeks previous to the 29TH day of MARCH, 2021, in some newspaper published in the County of HARRIS, if there be a newspaper published therein, but if not, then the nearest county where a newspaper is published, and this Citation shall be returned on the 26TH day of MARCH, 2021, which is forty-two days after the date it is issued, and the first publication shall be at least twenty-eight days before said return day. HEREIN FAIL NOT, but have before said court on said return day this Writ with your return thereon, showing how you have executed same.
