This suit is an eminent domain proceeding in which the State of Texas is condemning a tract of land located in Dallas County, Texas, containing 238,929 square feet of land, more or less, situated in the Franklin Brigance Survey, Abstract Number 103, Dallas County, Texas, and being a part of the 2.963 acre tract described in a deed 'om Raiford H. Stainback and wife, Lela Stainback to Texas Power and Light Company, executed September 1 1, 1962, recorded in Volume 5878, Page 663, Deed Records, Dallas County, Texas (D.R.D.C.T.), and part of the 3.838 acre tract described in a deed from W.E. Stainback to Texas Power and Light, executed on July 9, 1962, and recorded in Volume 5878, Page 657, said Deed Records, (D.R.D.C.T.), and a part ofthe 10.544 acre tract described in a deed from Clarence G. Woody and wife, Dorothy May Woody to Texas Power and Light, executed on December 7, 1962, and recorded in Volume 5922, Page 1, said Deed Records, (D.R.D.C.T.), a part of Tract 3, a 1.457 acre tract described in a deed from First-Wichita National Bank of Wichita Falls and Ralph A. Birk, as Co-Trustee of the C. Birk Heirs Trust to Texas Power and Light, executed on October 26 1962, and recorded in Volume 5899, Page 585, said Deed Records, (D.R.D.C.T.), said 238,929 square feet (5.4851 acres) of land, such property being fully described in Exhibit “A” of Plaintiffs Petition for Condemnation led under the above-referenced cause number.
